The Government of Argentina will seek to modify the gender identity law to prohibit children from accessing hormonal treatments or surgeries to adapt their bodies according to their gender identity, President Javier Milei spokesman, Manuel Adorni, reported Wednesday.

The official said that this seeks to “protect the physical and mental integrity” of children and adolescents because, in the opinion of the Executive, these measures harm those who are under 18 years.

“These interventions that are exposed to children is a serious risk to their health, both physical and mental, since it implies an interruption in their maturation process,” said Adorni in a message to the media, without presenting evidence.

The current law, approved in 2012 by the Legislative, allows the over 18 years to access hormonal treatments or surgeries to adapt their bodies with their self -perceived gender identity and, in the case of minors, it establishes that they must have the consent of its tutors and with the approval of a judge.

The Milei government said it will exercise its powers to modify laws by decree to prevent under any circumstances from a minor to access these interventions, Adorni said on Wednesday. At the same time, the Executive endorsed his decision in a statement.

The Constitution of Argentina empowers the President to issue legislative provisions through decrees under certain circumstances: the decrees of necessity and urgency, when a law cannot follow its usual course in the Legislative, and the delegated decrees, which delegate to the president legislative functions of public administration or emergency for a certain period, but only when a law of Congress authorizes it.

In this context, the Argentine Federation LGBT+ said that the country’s legislation does not allow Milei to modify the gender identity law by decree. “And if you try to resort to justice and the Inter -American Court if necessary,” said the organization in X.
